Chad Kenney: Background and Career of a U.S. District Judge

Chad Francis Kenney Sr. (born August 8, 1955) is a United States district judge of the United States District Court for the Eastern District of Pennsylvania. A native Pennsylvanian, Chad Francis Kenney Sr. was born in Lower Merion on August 8, 1955.

Senators Pat Toomey (R-Pa.) and Bob Casey (D-Pa.) introduced Chad Kenney, a nominee for the United States District Court for the Eastern District of Pennsylvania.

Education

He attended Villanova University, graduating cum laude in 1976 and then getting a J.D.

Early Legal Career

He began his legal career in 1980 as a civil litigator and later entered general practice. After graduation, Kenney worked at Benson Zion & Associates in Haverford for a year and then joined the Superior Court of Pennsylvania as a Staff Lawyer. From 1981 to 1983, he was a central legal staff lawyer for the Superior Court of Pennsylvania.

In 1983, Kenney joined the Law Office of Boardman and Schermer in Philadelphia. In 1992, Kenney joined O’Donnell & Kenney as a named partner. He practiced in Delaware County and Philadelphia as an associate, partner, and a sole practitioner, in both large and small firms.

Political and Judicial Appointments

Prior to his election to the bench, Kenney was elected twice as Delaware County Sheriff. From 1996 to 2003, he served as a Pennsylvania State Republican Committee member.

From 2003 to 2018, he served as a Judge of the Delaware County Court of Common Pleas. From 2003, Kenney has served as a Judge on the Delaware County Court of Common Pleas, which is the primary trial courts in Pennsylvania. From 2012 to 2017, he served as the court's President Judge.

During his time on the state bench, Kenney presided over cases in the family, criminal, civil, and orphans' sections. As a Judge, Kenney presided over cases in civil and criminal matters, as well as domestic relations, juvenile, and family law matters.

On December 20, 2017, President Donald Trump nominated Kenney to serve as a United States District Judge of the United States District Court for the Eastern District of Pennsylvania, to the seat vacated by Judge L. District Court for the Eastern District of Pennsylvania. This seat opened on January 11, 2016, when Judge L. Felipe Restrepo was appointed to the U.S. Court of Appeals for the Third Circuit.

After reaching out to Sen. Patrick Toomey (R-PA), Kenney interviewed for a judgeship with Toomey and his staff in February 2017. Kenney then interviewed with Sen.

Since Senator Toomey joined the Senate in 2011, Senators Toomey and Casey have worked together, in a bipartisan fashion, to fill vacancies on the federal bench in Pennsylvania. Together they have vetted, recommended, and confirmed 14 Federal District Court Judges for Pennsylvania. For the most part, close cooperation between Toomey and Casey on judicial nominations have spared Pennsylvania nominees the controversy that other states have drawn. Toomey supported the renomination of two Obama nominees, for example, who did not receive votes in 2016.

Key Rulings

In March 2019, Kenney dismissed a class action lawsuit against a landfill in Bethlehem, Pennsylvania, ruling that "residents didn't provide any arguments to prove that Bethlehem Landfill Co. In May 2019, Kenney awarded $33,000 in damages under the Telephone Consumer Protection Act (TCPA) for violating do-not-call requests. The plaintiff, James Everett Shelton, regularly brings lawsuits alleging violations of the TCPA, which allows $500 - $1500 in damages per call.

Controversies

Over his fifteen years on the bench, Kenney’s rulings have been reversed by higher courts five times. Of these reversals, the most significant is in Commonwealth v.

In 2013, Joseph De Ritis, a recently-terminated Delaware County public defender, filed a lawsuit naming Kenney as one of the defendants.
